1. (a) The Texas Commission on Environmental Quality shall consider the adequacy of, and decide whether to approve, any flood control or conservation improvement plan that:

   1. (1) is devised by the authority to achieve a plan or purpose for which the authority is created; and
   2. (2) contemplates improvements that are to be supervised by the commission under general law.

2. (b) Before the authority establishes a diversion point or constructs a canal, pumping plant, or other work under this chapter, the authority must:

   1. (1) present the plans and specifications for the project to the Texas Commission on Environmental Quality; and
   2. (2) obtain the approval of the commission.
