1. (a) The following persons are presumed to be authorized by the owner of a vessel to incur charges that give rise to a lien under this subchapter:

   1. (1) the managing owner;
   2. (2) the ship's husband;
   3. (3) the master;
   4. (4) the local agent; and
   5. (5) a person entrusted with management of the vessel at the port of supply.
2. (b) A person tortiously or unlawfully in possession or charge of a vessel may not bind the vessel.
