Tex. Penal Code § 21.06

Homosexual Conduct

Section 21.06 was declared unconstitutional by Lawrence v. Texas, 123 S.Ct. 2472.

  1. (a) A person commits an offense if he engages in deviate sexual intercourse with another individual of the same sex.
  2. (b) An offense under this section is a Class C misdemeanor.
