The department shall issue the applicable establishment license under this subchapter to an applicant if:

1. (1) the applicant:

   1. (A) owns or rents the establishment;
   2. (B) verifies the application;
   3. (C) complies with the application requirements of this chapter;
   4. (D) pays the required inspection and license fees; and
   5. (E) has not committed an act that constitutes a ground for denial of a license; and

2. (2) the establishment:

   1. (A) meets the commission's minimum health standards for an establishment; and
   2. (B) complies with all commission rules.
