1. (a) The Texas State Board of Public Accountancy consists of 15 members appointed by the governor with the advice and consent of the senate as follows:

   1. (1) 10 certified public accountant members, at least eight of whom are, on the date of appointment:

      1. (A) a sole practitioner; or
      2. (B) an owner or employee of a certified public accountancy firm; and

   2. (2) five public members who are not:

      1. (A) licensed under this chapter; or
      2. (B) financially involved in an organization subject to board regulation.
2. (b) Each member of the board must be a United States citizen.
3. (c) Appointments to the board shall be made without regard to the race, color, disability, sex, religion, age, or national origin of the appointee.
