1. (a) The Texas Optometry Board consists of nine members appointed by the governor with the advice and consent of the senate as follows:

   1. (1) six optometrists or therapeutic optometrists; and
   2. (2) three members who represent the public.
2. (b) Appointments to the board shall be made without regard to the race, color, disability, sex, age, religion, or national origin of the appointee.
