A member of the board may not express an oral or written opinion or serve as an expert witness in a civil action that is:

1. (1) related to an administrative matter within the board's jurisdiction;
2. (2) brought against or for a person licensed or registered under this subtitle; and
3. (3) for the injury to or death of a patient or for a violation of the standard of care or the commission of malpractice.
