1. (a) An applicant for a license under this subchapter must submit to the department:

   1. (1) an application form prescribed by the department;
   2. (2) any other information required by the department; and
   3. (3) a fee in an amount set by the department.

2. (b) The department shall conduct a criminal background check on each applicant who submits an application for a license under this subchapter and on any controlling person of the applicant. The department may, as permitted by law:

   1. (1) examine any criminal conviction, guilty plea, or deferred adjudication of the applicant or controlling person; and
   2. (2) obtain any criminal history or record of the applicant or controlling person.
