The commission shall adopt rules to license and regulate pari-mutuel wagering on:

1. (1) races conducted in this state and simulcast to in-state racetrack associations or out-of-state receiving locations; and
2. (2) races conducted out-of-state and simulcast to in-state racetrack associations.
