1. (a) A person commits an offense if:

   1. (1) the person knowingly violates this chapter or a rule adopted or certification issued under this chapter; and
   2. (2) the violation endangers the public health and safety.

2. (b) An offense under this section is a misdemeanor punishable by:

   1. (1) a fine not to exceed $10,000;
   2. (2) confinement for a term not to exceed six months; or
   3. (3) both the fine and the confinement.
