The department may conduct a criminal history record information check of each applicant or, if applicable, any controlling person of an applicant for a registration under this chapter using information:

1. (1) provided by the applicant; and
2. (2) made available to the department by the Department of Public Safety and any other criminal justice agency under Chapter 411, Government Code.
