1. (a) An employee of the commission commits an offense if the employee knowingly:

   1. (1) performs a function or duty under this chapter; and
   2. (2) has a direct or indirect financial interest in an underground or surface coal mining operation.

2. (b) An offense under this section is punishable by:

   1. (1) a fine of not more than $2,500;
   2. (2) imprisonment for not more than one year; or
   3. (3) both the fine and the imprisonment.
