1. (a) On receipt of the notice and request, the commission shall conduct an inspection and evaluation of the reclamation work involved, the inspection and evaluation to occur within a reasonable time not to exceed 45 days.

2. (b) The evaluation shall consider among other things:

   1. (1) the degree of difficulty to complete remaining reclamation;
   2. (2) whether pollution of surface and subsurface water is occurring;
   3. (3) the probability of continuance or future occurrence of pollution; and
   4. (4) the estimated cost of abating pollution.
