In any order adopted under this subchapter, the commissioners court may adopt the following criminal penalties for violation of the order:

1. (1) for a first conviction, a fine of not less than $50; nor more than $100;
2. (2) for a second conviction, a fine of not less than $100 nor more than $200;
3. (3) for any subsequent convictions after the second conviction, a fine of not less than $200 nor more than $1,000 or confinement in the county jail for not more than 60 days, or both.
