This subchapter applies to the areas of Padre Island located in Cameron or Willacy County and located:

1. (1) outside a municipality but within two miles of a publicly owned park or recreational development; or
2. (2) within two miles of a beach, wharf, or bathhouse used by at least 500 persons annually.
