In this subchapter:

1. (1) "Category One violation" means a violation of the ethics code adopted by the commission as to which it is generally not difficult to ascertain whether the violation occurred or did not occur, including:

   1. (A) the failure by a person required to file a statement or report required under the ethics code to:

      1. (i) file the statement or report in a manner that complies with applicable requirements; or
      2. (ii) file the statement or report in a timely manner;
   2. (B) a misrepresentation in a report required under the ethics code; or
   3. (C) a failure to respond in a timely manner to a written notice under Section 161.156(b).
2. (2) "Category Two violation" means a violation of the ethics code adopted by the commission that is not a Category One violation.
