1. (a) An employer who elects to provide workers' compensation insurance coverage may include in the coverage a real estate salesperson or broker who is:

   1. (1) licensed under Chapter 1101, Occupations Code; and
   2. (2) compensated solely by commissions.
2. (b) If coverage is elected by the employer, the insurance policy must specifically name the salesperson or broker. The coverage continues while the policy is in effect and the named salesperson or broker is endorsed on the policy.
