If after notice an employer does not pay a contribution or a penalty or interest on a contribution, the commission shall collect the amount due by:

1. (1) bringing a civil action in the name of the state and the attorney general in a district court in Travis County; or
2. (2) serving a notice of assessment on the defaulting employer, stating the amount of the contribution, penalty, and interest outstanding.
