Tex. Ins. Code § 541.403

Denial of Petition

  1. (a) The department must state in writing the reason for denying a petition to adopt, amend, or repeal a rule.
  2. (b) The department is expressly authorized to deny the petition if the action sought would:

    1. (1) destroy uniformity with the laws of other states or the United States; or
    2. (2) not conform to the adopted procedures of the National Association of Insurance Commissioners.
