A carrier is subject to disciplinary action under Chapter 82 if the carrier or the carrier's agent fails or refuses to comply with:

1. (1) this subchapter or a rule adopted under this subchapter; or
2. (2) a request by the department or an appointed examiner to be examined or to provide information requested as part of an examination.
