1. (a) Except as provided by Section 775.107 or 775.115, the fire marshal may not exercise the powers granted under this subchapter in:

   1. (1) the territory of a municipality that has a municipal fire marshal; or
   2. (2) the territory of a county that has a county fire marshal.
2. (b) This subchapter does not change or otherwise limit the authority of any state agency to prevent and extinguish forest and grass fires.
