- (a) In a 10-county region with a population of less than 300,000, a council of governments is not required to prepare a regional solid waste management plan for that region if a public agency other than a municipality or county has received state funds for that purpose and has prepared a plan that has been approved by the state agency that administered the state funds.
- (b) In this section, "council of governments" means a regional planning commission created under Chapter 391, Local Government Code.
