This chapter applies only to:

1. (1) a county that:

   1. (A) is not served by a hospital district or a public hospital;
   2. (B) has a population of more than 75,000; and
   3. (C) borders or includes a portion of the Sam Rayburn Reservoir; and
2. (2) a county that has a population of more than 200,000 and less than 233,500.
