1. (a) The disclosure statement must provide the location and a description of the proposed or existing physical property of the facility.

2. (b) If the physical property of the facility is proposed, the disclosure statement must state:

   1. (1) the estimated completion date;
   2. (2) whether construction has begun; and
   3. (3) any contingencies under which construction may be deferred.
