A treatment facility may not own, operate, manage, or control an intervention and assessment service that makes referrals to a treatment facility for inpatient treatment of mental illness or chemical dependency unless the intervention and assessment service:

1. (1) is a qualified mental health referral service under Section 164.007;
2. (2) discloses in all advertising the relationship between the treatment facility and the intervention and assessment service; and
3. (3) discloses to each person contacting the service, at the time of initial contact, the relationship between the treatment facility and the intervention and assessment service.
