The department may contract with a physician to provide services to persons infected or reasonably suspected of being infected with a sexually transmitted disease or tuberculosis if:

1. (1) local or regional health department services are not available;
2. (2) the person in need of examination or treatment is unable to pay for the services; and
3. (3) there is an immediate need for examination or treatment of the person.
