A juvenile board or juvenile probation department is entitled to obtain from the department criminal history record information maintained by the department that relates to a person who is:

1. (1) an applicant for a position with the juvenile probation department;
2. (2) an employee for whom the juvenile board or juvenile probation department will seek certification from the Texas Juvenile Justice Department; or
3. (3) an employee or department applicant who currently holds certification from the Texas Juvenile Justice Department.
