1. (a) In this section:

   1. (1) "Facility" has the meaning assigned by Section 106.001, Human Resources Code.
   2. (2) "Nurse aide" has the meaning assigned by Chapter 106, Human Resources Code.
   3. (3) "Organization that provides temporary nurse aides" includes a temporary employment service, nursing pool, private duty nurse service, or sitter service.

2. (b) An organization that provides temporary nurse aides to a facility is entitled to obtain from the department criminal history record information maintained by the department that relates to a person who is:

   1. (1) a nurse aide; and
   2. (2) a candidate for referral by the organization to a facility.
