This subchapter does not prohibit an institution of higher education from offering workforce education or workforce training and services that:

1. (1) are needed by an employer located in the institution's taxing district and that meet all applicable standards; or
2. (2) have been approved under applicable law and that are reviewed by the Texas Higher Education Coordinating Board.
