In this chapter, "state agency":

1. (1) means an office, institution, or other agency that:

   1. (A) is in the executive branch of state government;
   2. (B) has authority that is not limited to a geographic portion of the state; and
   3. (C) was created by the constitution or a statute of this state; and
2. (2) does not include an institution of higher education as defined by Section 61.003, Education Code.
