In this chapter:

1. (1) "State agency" means a board, commission, department, office, or other agency, except a university system or institution of higher education as defined by Section 61.003, Education Code, that:

   1. (A) is in the executive branch of state government;
   2. (B) has statewide authority; and
   3. (C) is created by the constitution or by statute.

2. (2) "Functional area" means one of the following areas of concern to state government:

   1. (A) natural resources;
   2. (B) health and human resources;
   3. (C) education;
   4. (D) economic development and transportation;
   5. (E) agriculture;
   6. (F) public protection;
   7. (G) consumer protection;
   8. (H) work force; or
   9. (I) any other area in which the governor appoints an interagency planning council under Section 772.003.
