A state agency may distribute a copy of a publication to a person or other entity that is not listed on the publication distribution list only if:

1. (1) the person or entity has requested orally or in writing a specific copy of the publication; or
2. (2) the person is a newly elected or appointed state officer, newly appointed executive head of a state agency, or newly established state agency.
