1. (a) The total amount paid with state funds in a particular primary election year for the combined compensation of a county chair and the secretary, if any, of the county executive committee presided over by the chair may not be:

   1. (1) less than $300; or

   2. (2) more than the lesser of

      1. (A) $8,000; or
      2. (B) five percent of the total expenses incurred by the political party in holding primary elections in the county that year, exclusive of the combined annual compensation of the county chair and secretary.
2. (b) The status of a county executive committee's secretary as a committee member does not affect the applicability of this section.
