It shall be the duty of the county school board or boards or the commissioners court or courts petitioned in compliance with Section 130.033 of this code to:

1. (1) pass upon the legality of the petition and the genuineness of the same; and
2. (2) forward the petition, so approved, to the Coordinating Board, Texas College and University System.
