The attorney general shall file an action against a foreign filing entity in the name of the state seeking the revocation of the entity's registration if:

1. (1) the entity has not cured the problems for which revocation is sought before the 31st day after the date the notice under Section 9.152(b) is mailed; and
2. (2) the attorney general determines that cause exists for judicial revocation of the entity's registration under Section 9.151.
