Tex. Bus. & Com. Code § 16.055 – Disclaimer of Unregistrable Component

(a) The secretary of state may require the applicant to disclaim an unregistrable component of a mark that is otherwise registrable. An applicant may voluntarily disclaim a component of a mark sought to be registered.
(b) A disclaimer may not prejudice or affect:
1. (1) the rights of the applicant or registrant in the disclaimed matter; or
2. (2) the rights of the applicant or registrant to submit another application to register the mark if the disclaimed matter is or has become distinctive of the applicant's or registrant's goods or services.
