The commission shall adopt rules providing that a telemarketing call made to a telephone number on the Texas no-call list is not a violation of Section 304.052 if the telemarketing call:

1. (1) is an isolated occurrence; and
2. (2) is made by a person who has in place adequate procedures to comply with this subchapter.
