This chapter does not apply to:

1. (1) the solicitation of a contract for the maintenance or repair of an item previously purchased from the person making the solicitation or on whose behalf the solicitation is made; or

2. (2) a person who:

   1. (A) is soliciting business from a former or current customer; and
   2. (B) has operated under the same business name for at least two years.
