1. (a) A person commits an offense if, with intent to obtain a benefit for himself or to harm another, he:

   1. (1) institutes a claim under this chapter in which he knows he has no interest; or
   2. (2) institutes any suit or claim under this chapter that he knows is false.
2. (b) An offense under this section is a Class B misdemeanor.
