The department shall enforce this subchapter and may adopt rules as necessary for the immunity and protection of plants from diseases and insect pests, including rules that:

1. (1) regulate the traffic, growing, shipping, selling, and leasing of nursery products;
2. (2) provide for the inspection and control of florist items; and
3. (3) relate to city, private, or public parks, or shade trees, shrubbery, and ornamentals along city streets or property or on city residences.
