A person violates this chapter if the person or the person's servant or agent:

1. (1) sells or offers or exposes for sale a quantity of a commodity or service that is less than the quantity the person represents; or
2. (2) as a buyer furnishing the weight or measure of a commodity or service by which the amount of the commodity or service is determined, takes or attempts to take more than the quantity the person represents.
