1. (1) The Comptroller of the Treasury will establish per diem reimbursement rates for nursing facility Level I services provided to Tennessee Medicaid recipients.

2. (2) The Comptroller of the Treasury will use:

   1. (a) the cost report required by rule 0380-1-10-.07,
   2. (b) budgeted information supplied by the provider,
   3. (c) the charge system of the provider, and
   4. (d) any other data the Comptroller considers relevant in rate determination.
