Unused Drugs, Devices, and Related Materials

- (1) Discontinued, outdated, defective, or deteriorated drugs, devices, or related materials and containers with worn, illegible, or missing labels shall be returned to the pharmacy practice site for proper disposition. All such drugs, devices or related materials returned to the pharmacy practice site must be destroyed unless in unit dose packaging, unopened INFUSION PHARMACY PRACTICE SITES commercially prepackaged containers and in the professional judgment of the pharmacist in charge or designee, the medications or related materials meet all federal and state board standards for product integrity.
- (2) Upon request, the Board may waive selected portions of these requirements so long as any waiver granted is consistent with the Board’s authority under Tenn. Code Ann. Title 63, Chapters 1 and 10, and Tenn. Code Ann. Title 4, Chapter 5.
