1. (1) Each Facility shall prepare a Diversion Control Plan that contains specific measures to reduce the possibility of diversion of controlled substances from legitimate medical treatment use and that assigns specific responsibility to the medical and administrative staff of the Facility for carrying out the diversion control functions described in the Diversion Control Plan. These measures may include patient call backs. The Diversion Control Plan shall address, at a minimum, the following scenarios that may indicate diversion:

   1. (a) The patient has been reported to be diverting medication.
   2. (b) The patient’s recent drug screen results show an absence of the treatment medication.
   3. (c) The patient’s urine drug screen is identified as not belonging to the patient or is otherwise adulterated.
   4. (d) Results from the patient’s CSMD check demonstrate significant variation from the patient’s treatment plan.
