(1) Facilities which perform or arrange for psychosurgery or other surgical procedures for the intervention in or alteration of a mental, emotional, or behavioral disorder must assure the following:
- (a) Written, informed consent must be obtained from the patient or guardian. Consent may be withdrawn at any time. Psychosurgery or other surgical procedures may not be performed on minors;
- (b) Clinical justification for the use of psychosurgery or other surgical procedures must be documented in the patient’s record and must reflect consideration of other less- intrusive treatments; and
- (c) The decision to perform psychosurgery or other surgical procedures must be made following consultation with a psychiatrist and a neurosurgeon.
