1. (1) Malpractice reporting requirements. Pursuant to the “Health Care Consumer Right-to-Know Act of 1998” codified at T.C.A. §§ 63-32-101, et seq., licensees shall report any and all professional malpractice judgments, awards or settlements in which payments to complaining parties exceed ten thousand dollars ($10,000).

2. (2) Criminal conviction reporting requirements. For purposes of the “Health Care Consumer Right-To-Know Act of 1998”, the following criminal convictions must be reported:

   1. (a) Conviction of any felony.

   2. (b) Conviction or adjudication of guilt of any misdemeanor, regardless of its classification, in which any element of the misdemeanor involves any one or more of the following:

      1. 1. Sex.
      2. 2. Alcohol or drugs.
      3. 3. Physical injury or threat of injury to any person.
      4. 4. Abuse or neglect of any minor, spouse or the elderly. AND ESTABLISHMENTS
      5. 5. Fraud or theft.
   3. (c) If any misdemeanor conviction reported under this rule is ordered expunged, a copy of the order of expungement signed by the judge must be submitted to the Department before the conviction will be expunged from any profile.
3. (3) Licensees shall notify the Board Administrative Office within thirty (30) days of a reportable event under this rule (malpractice payment or conviction).
