1. (1) Notwithstanding the provisions of Rule 0800-09-01-.03, the Administrator may extend the period during which a claimant may file a claim for partial unemployment benefits if the Administrator finds that the failure of any individual to register and file a claim for such benefits within the time set forth in 0800-09-01-.03 of these regulations was due to:

   1. (a) the employer’s failure to comply with any of the provisions of the Tennessee Employment Security Law or the Rules of The Department of Labor and Workforce Development, Division of Employment Security, or
   2. (b) the employer’s exercising coercion or intimidation to prevent the prompt filing of such claim, or
   3. (c) the Department’s failure to discharge its responsibilities promptly in connection with such partial unemployment.
