If the commissioner finds that a debt-resolution services provider has violated a provision of the Act, a rule adopted pursuant to the Act, or any other law applicable to the conduct of a licensee, then the commissioner may order or impose a penalty upon the provider, which must not exceed five thousand dollars ($5,000) per violation, up to a maximum of one hundred thousand dollars ($100,000), plus costs of investigation. Each day a violation occurs may be considered a separate offense.
