(1) General
(a) The commissioner delegates to the assistant commissioner all of the power and duties granted to and imposed upon the commissioner by the Act except the power:
- 1. To issue orders and impose any sanction pursuant to T.C.A. §§ 47-18-5533 (a)(1), (2), (3) and (b), or 47-18-5534(b) and (c) in any contested case, as such term is defined in the UAPA; and
- 2. To adopt any rule as such term is defined in the UAPA.
(b) Without limiting the foregoing delegation, the assistant commissioner is expressly empowered to:
- 1. Conduct examinations and investigations as provided by T.C.A. § 47-18-5532(b);
- 2. Issue registrations; and
- 3. Accept on behalf of the commissioner settlement agreements reached between the Division and any person pursuant to T.C.A. § 4-5-105.
- (c) Nothing herein limits the assistant commissioner’s authority, duties, or responsibilities set forth elsewhere in state law, regulation, or rule.
