1. (1) Each trust instrument, and any amendments thereto, shall be filed with the Commissioner. Each trust instrument shall specify:

   1. (a) the name of the contract seller;
   2. (b) the name of the trustee;
   3. (c) the trustee’s duties in conformance with the provisions of these rules;
   4. (d) the basis for determining the trustee’s fee (if any); and
   5. (e) any other appropriate terms of the trusteeship.
2. (2) Each trust instrument shall bind the trustee to make available at reasonable times and places, on request by a contract buyer, the trustee’s records of the trust account established pursuant to the contract buyer’s pre-need contract.
3. (3) The Commissioner may require alterations or additions to a trust instrument if the Commissioner finds that it is not in accord with the provisions of these rules.
